Why Is Title Insurance Important?

 

Title insurance provides a "safety fence" around your property that can save you time, money, and trouble - even your home!

 

 

Who Is Covered?

 

Your lender normally requires title insurance that protects the lender up to the outstanding balance of your mortgage, but that policy doesn't protect your interest in the property.

You (the buyer) can purchase a separate title insurance policy that protects your interest in the event of a claim.

 

 

What risks are covered?

 

The exact coverage depends on the individual policy buy typically these hidden risks are covered:

· Errors - incorrect information in deeds, mortgages, public records, etc.

· Liens - claims against the property or the seller that become the new owner's responsibility after the sale.

· Claims to ownership such as a spouse or child of a former owner.

· Invalid deeds - transfer by a seller who did not actually own the property or a previous owner who was not mentally competent.

 

 

What's Not Covered?

 

There may be standard exclusions such as land use or unpaid bills.  There may also be exceptions such as easements, rights of way and other legal obligations noted in the deed or public records.  There may also be restrictive covenants that restrict the use of your property.
